Terms of Service

1. Acceptance of Terms

By accessing or using Learnable (learnable.co.za), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. If you are under 18, you must have parental or guardian consent to use this service.

2. Description of Service

Learnable is an AI-powered tutoring platform aligned with the South African CAPS curriculum. We provide voice-based tutoring sessions with an interactive canvas for learning. Our AI tutors assist with understanding concepts but do not replace qualified teachers or guarantee specific academic outcomes.

3. Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must not share your account with others.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscription Plans & Billing

• Free Plan: 30 minutes per month, 15-minute session cap, Sage voice tutor.
• Learner Plan (R149/month): 10 hours per month, 20-minute session cap, all voice tutors.
• Pro Plan (R249/month): 25 hours per month, 20-minute session cap, all voice tutors.
• Paid subscriptions are billed monthly via PayFast and renew automatically.
• Unused minutes do not roll over to the next billing period.
• Prices are in South African Rand (ZAR) and include VAT.

5. Cancellation & Refunds

• You may cancel your subscription at any time from your Settings page.
• Upon cancellation, your plan will be downgraded to Free immediately.
• We do not offer refunds for partial months or unused minutes.
• If you believe you were charged in error, please contact us within 7 days at hello@learnable.co.za.

6. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose.
• Attempt to manipulate or abuse the AI tutor system.
• Upload inappropriate, harmful, or offensive content to the canvas.
• Attempt to circumvent usage limits or billing systems.
• Reverse-engineer, copy, or redistribute any part of the service.

7. AI Limitations

Our AI tutors are designed to help you understand concepts, but they may occasionally provide inaccurate or incomplete information. Learnable is a supplementary learning tool and should not be your sole source of study material. Always verify important information with your textbooks and teachers.

8. Intellectual Property

All content, features, and functionality of Learnable are owned by us and are protected by South African and international intellectual property laws. Content you create during learning sessions (drawings, notes) belongs to you, but we retain the right to use anonymised, aggregated data to improve our service.

9. Limitation of Liability

Learnable is provided "as is" without warranties of any kind. We are not liable for any academic outcomes, exam results, or decisions made based on information provided by our AI tutors. Our total liability to you shall not exceed the amount you have paid us in the preceding 12 months.

10. Changes to Terms

We may update these Terms of Service from time to time. We will notify users of material changes via email or an in-app notice. Continued use of the service after changes constitutes acceptance of the updated terms.

11. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
